Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Ampaly mobile application ("App") provided by Ampaly ("we", "us", or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, do not use the App.

1. Description of the App

Ampaly is a local-first personal budgeting and financial forecasting application. It allows you to:

• Track multiple financial accounts and their balances,
• Create recurring or one-time transaction contracts (incomes and expenses),
• Generate, adjust, and settle projected operations over time,
• Forecast how your balances may evolve based on the rules and data you enter,
• Export and import local backups of your App data.

The App is designed to store budgeting content locally on your device. No Ampaly account is required.

2. Eligibility

The App is intended for personal, non-commercial use. By using the App, you represent that you are at least 16 years of age (or the minimum age required by applicable law in your jurisdiction) and that you are not prohibited from using the App under any applicable law.

3. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on a device you own or control, solely for your personal, non-commercial purposes.

You may not:

• Copy, modify, or distribute the App or any part of it,
• Reverse-engineer, decompile, or disassemble the App,
• Use the App for any unlawful purpose or in violation of any applicable regulation.

4. Subscription and In-App Purchases

4.1 Free Tier

The App is available to download and use free of charge. The free tier includes:

• Up to 2 financial accounts,
• 5 transactions,
• Access to the standard themes currently available to free users.

4.2 Ampaly Be Subscription

Additional features are available through the "Ampaly Be" paid subscription plan, including:

• More than 2 accounts,
• More than 5 transaction contracts,
• Access to premium themes, which currently include Mena and Omby Lahy.

The subscription price is the amount displayed in the store on your device at the time of purchase. Pricing may vary by region, taxes, store policies, and future updates.

4.3 Billing and Renewal

Subscriptions are managed and processed through the app marketplace used on your device, such as the Apple App Store or Google Play, if available for your platform. Charges, billing cycles, renewals, cancellation timing, and store terms are governed by that marketplace.

4.4 Cancellation and Refunds

You may cancel your subscription through the relevant marketplace account settings. Cancellation generally takes effect at the end of the current billing period unless the store states otherwise. Refunds, if any, are handled by the marketplace under its own policies.

4.5 Apple App Store Additional Terms

• If you purchase an auto-renewable subscription through the Apple App Store, payment will be charged to your Apple ID account at confirmation of purchase.
• The subscription renews automatically unless it is canceled at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours before the end of the current period.
• You can manage or cancel your subscription at any time in your Apple ID account settings after purchase.

5. Data and Storage

All data you enter in the App (including accounts, transaction contracts, generated operations, balances, and settings) is stored primarily on your device. You are solely responsible for maintaining the accuracy of this data and for safeguarding any exported backups.

5.1 No Current Cloud Sync

The current version of the App does not provide operational iCloud sync or another Ampaly-managed cloud sync service for your budgeting data.

5.2 Export and Import

You may export your data as a .ampaly file (JSON format) and import it on another device. Imported backups do not transfer ownership of any paid subscription. If imported data exceeds the free-plan limits, an active Ampaly Be subscription may be required to complete the import.

6. Analytics and Diagnostics

The current App includes Firebase Analytics and Firebase Crashlytics in non-development builds. These services are used to understand screen usage, app performance, and technical failures. They are not intended to receive the content of your budgeting entries. More details are provided in the Privacy Policy.

7. Intellectual Property

The App, including its design, graphics, themes, code, and content (excluding data you enter), is the exclusive property of Ampaly. Nothing in these Terms grants you any rights in the App's intellectual property other than the limited license described in Section 3.

8. Availability and Changes

We may modify, suspend, or discontinue all or part of the App, including features, themes, subscription benefits, legal URLs, or store availability, at any time. Some functionality may depend on your device, operating system, or third-party marketplace availability.

9. Disclaimer of Warranties

The App is provided "as is" and "as available", without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

• The App will be uninterrupted, error-free, or free of viruses,
• Any financial forecasts or projections generated by the App are accurate or suitable for any financial decision.

Ampaly is a personal planning tool. It does not constitute financial advice.

10. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Ampaly be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the App, even if advised of the possibility of such damages.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of France.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via an in-app notice or an update to the "Last updated" date above. Continued use of the App after such changes constitutes your acceptance of the revised Terms.
